After the new government came, former ministers, state ministers, army officers, judges, journalists and many others were arrested. Many accused have been harassed in different ways while being taken to the courtroom for remand. There has been a lot of discussion and criticism about this incident taking place in a sensitive place like the court amid police security. No one wants such a situation.
Still, the responsibility for the safety of all citizens must be given to the government. However, the government informed that the attack on the court premises is not acceptable under any circumstances. So that this does not happen, the government is thinking about various strategies.
According to Section 12 of the Constitution and the Police Regulations of Bengal, 1943 (PRB), the police are responsible for the security of the accused during their transportation from custody or from prison to the court. When a person is arrested and in police custody, all responsibility lies with the law enforcement agencies. He will be safe because he is arrested. Even if there is no security while staying outside, the police will provide security for him while he is in police custody.
There was never an exception, never in the law. But now that this phenomenon has developed, it is often seen that after arresting someone, they may be assaulted on the way to court. Maybe someone has a grudge against them, but it is the responsibility of those taking the court to provide that protection.
If an accused cannot be brought to court, there is an alternative system. Now available digitally. Court can be held where the accused is with the permission of the Magistrate. If it seems that taking the accused inside the court is very risky, the law-and-order forces will not be able to provide protection then such alternative measures can be taken. Any victim of harassment can also raise questions. Security has to be given, there is no alternative. They have to take responsibility for failure.
Here the police and those in the judiciary must bring control to the court area. To be safe. Again, the accused are not allowed to consult their lawyers. It hinders the judicial process. The state will be equal for all, humane. Accused shall not be subjected to any kind of inhuman treatment. I feel that our administration has not performed its due responsibilities properly. We hope that no more incidents of harassment will happen in the coming days.
